Under the settlement agreement, Ripps and its partners will be barred from continuing to use Yuga Labs’ related images and trademarks; specific terms have not been fully disclosed yet. The case began in 2022, when Ripps launched a counterfeit NFT series, RR/BAYC, using the same ape imagery as BAYC, and called it “expressive appropriation art.” Yuga Labs then filed a lawsuit for trademark infringement. In 2023, a U.S. court ruled that the counterfeit project constituted trademark infringement and ordered approximately $9 million in damages. After that, the appeals court partially overturned the decision and required a retrial, putting the case into a prolonged back-and-forth phase.
