Federal appeals court to decide whether to revive environmental groups' lawsuit against Suncor

A federal appeals court is currently deliberating whether to reinstate a lawsuit filed by environmental groups, including Colorado GreenLatinos and Sierra Club, against Suncor for alleged ongoing pollution violations. The groups initially sued in 2024, arguing state and federal regulators were not adequately protecting residents near Suncor’s Commerce City refinery. After a district court dismissed the case, Earthjustice attorneys are now arguing that citizens should be allowed to sue if regulators are not diligently enforcing pollution laws, asserting that Suncor’s past consent decrees are no longer active and fail to deter violations.
