The U.S. prosecutors oppose the DeFi Education Fund (DEF) submitting a amicus brief, claiming it has no direct relevance to the case and that the court has previously dismissed its main legal arguments. Currently, the Southern District Court of New York is considering whether to rehear the case involving two brothers accused of profiting $25 million from Ethereum through MEV-related operations. The case was previously declared a mistrial due to a deadlocked jury, and prosecutors have requested a new trial to be scheduled for late February or early March 2026. DEF previously stated that the case has industry implications, expressing concerns that similar prosecutions could create regulatory uncertainty, hinder developers and DeFi innovation, and that the judiciary should not preempt legislation.
